These terms and conditions ("General Terms and Conditions of Sale") govern the sale of products ("Products") by Equicust'Home S.a.r.l. ("Equicust'Home", "we" or "us") with registered office in Chem. de la Paix, 4b, 1802 Corseaux (Switzerland), VAT number CHE-451.443.947 to customers ("Customers", "you" or "you") through the website www.genki.it ("Website").

1. Subject Matter of the Contract

These General Terms and Conditions of Sale govern the online sale of Products offered by Equicust'Home on the Website. The images and descriptions of the Products on the Website are provided for information purposes only and do not constitute a binding contract. Equicust'Home reserves the right to modify the information on the Products at any time without notice.

2. Product Information

2.1 Availability of Information: The information and essential characteristics of the Products offered for sale on Genki.it are available on the Website. The User can consult this information in the descriptive sheet of each Product, which includes details on technical characteristics, materials, dimensions, price and other useful information.

2.2 Images and Visual Representations: The visual representation of the Products on the Website, where available, normally corresponds to the photographic image accompanying the descriptive sheet. However, it is important to specify that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their real characteristics and qualities. In particular, there may be slight differences in color and size between the image and the physical Product. In case of discrepancy between the image and the written description in the product sheet, the detailed description present on the sheet itself always prevails.

3. Disclaimer

3.1 The information contained on the Website, including descriptions, images and other content related to the Products, is provided for information purposes only and should not be considered as medical, legal or other advice. Equicust'Home assumes no responsibility for the accuracy, completeness or timeliness of such information.

3.2 All information provided on Genki.it, including Product descriptions and properties, has not been evaluated by the European Food Safety Authority (EFSA) or other competent regulatory bodies.

3.3 The Products offered for sale on Genki.it are not intended to diagnose, treat, cure or prevent any disease. The User is aware that the Products can be used for purposes other than curative ones and assumes full responsibility for their use.

3.4 Equicust'Home does not provide any express or implied warranty regarding the suitability of the Products for specific purposes or their compliance with any law or standard. The User is solely responsible for choosing the Product that suits his needs and for its safe and lawful use.

3.5 Equicust'Home is in no way responsible for direct, indirect, special, incidental or consequential damages arising from the use of the Products or the information contained on the Website, even if Equicust'Home has been informed of the possibility of such damages.

3.6 The User declares to be aware of the limitations mentioned above and to assume full responsibility for the purchase and use of the Products.

4. Conclusion of the Contract

The sales contract between Equicust'Home and the Customer is concluded with the acceptance of the order by Equicust'Home. The acceptance of the order is sent to the Customer via email to the address indicated by the Customer himself. The order confirmation email will contain a summary of the order details, including the ordered Products, the total price, and shipping costs.

5. Prices and Payments

The prices of the Products indicated on the Website are inclusive of VAT, but do not include shipping and delivery costs. Shipping and delivery costs will be calculated and communicated to the Customer during the checkout process. The Customer can pay for the Products and shipping and delivery costs using the payment methods indicated on the Website.

6. Shipping and Delivery

The Products will be shipped to the Customer within 4 working days from the acceptance of the order. The Customer will receive a shipping notification email with the tracking number to track the delivery status.

6.1 Shipping costs are free throughout the national territory for orders over €89.00. For orders under €89.00, the shipping cost is €9.90.

7. Direct Shipping from the Manufacturer and Separate Delivery of Items in Packs

In order to offer our customers maximum flexibility and speed of delivery, some products may be shipped directly from the manufacturer. In such cases, delivery times may be slightly longer than for standard products.

In addition, it is important to note that, in the case of bundles of products from different manufacturers, the items may arrive separately if not all components of the bundle are available in our warehouse.

In such cases, the customer will receive an email with the tracking number of each individual shipment.

We are committed to ensuring maximum transparency and communication throughout the entire purchase and shipping process, to offer our customers a serene and satisfactory shopping experience.

8. Right of Withdrawal

The User has the right to withdraw from the purchase contract within 14 days from the date of receipt of the product. To exercise the right of withdrawal, the User must notify Equicust'Home via email to the address info@genki.it. The User must then return the product at his own expense within 14 days from notification of withdrawal. Equicust'Home will refund the price of the product to the User within 14 days of receipt of the returned product.

8.1 Only undamaged Products that have not been opened, used, manipulated, modified and that still have the original and intact packaging can be returned.

9. Warranty and Defects of Conformity

9.1 In case of defects of conformity of the Products purchased on Genki.it, the User is required to promptly contact Equicust'Home Customer Service by sending an email to info@genki.it.

9.2 The legal warranties provided by the Swiss Federal Consumer Protection Act (LCP) apply to the sale of the Products. In case of lack of conformity, the User has the right, at his choice and provided that the nature of the Product allows it:

• Free restoration of conformity: The Product can be repaired or replaced free of charge.
• Price reduction: The User can obtain a reduction proportional to the price of the defective Product.
• Termination of the contract: The User can obtain a refund of the price paid and the return of the defective Product.

9.3 Equicust'Home is liable to the User for any lack of conformity existing at the time of delivery of the Product and which becomes apparent within two years of such date.

9.4 If the defect occurs within one year from the delivery of the Product, it is presumed to have already existed at the time of delivery, unless proven otherwise by the Seller.

9.5 The complaint of a lack of conformity that occurs after one year from the delivery of the Product must be made in writing, specifying and documenting in detail the defects found.

11. Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by and construed in accordance with Swiss law. For any dispute arising from these General Terms and Conditions of Sale, the competent jurisdiction shall be that of Lausanne, Switzerland.

12. Final Clauses

If any clause of these General Terms and Conditions of Sale is deemed null or void, such clause shall be considered omitted and the remaining clauses shall remain in full force and effect. Equicust'Home reserves the right to modify these General Terms and Conditions of Sale at any time. Changes to the General Terms and Conditions of Sale will be published on the Website and will take effect from the date of publication.
